Your corporate client has just been informed that a rogue employee may have committed a major fraud against the government. You, as its civil attorney, should be aware of the implications of this information. In your role as the civil attorney, you will have to aid your client in making decisions that will extricate your client from a criminal and civil lawsuit or at least to minimize the consequences. Your client will be confronted with many issues that will determine the outcome of your client’s fate. Such issues may be whether to conduct an internal investigation, whether to hire outside counsel to conduct an internal investigation, what steps need to be taken in an internal investigation and whether to disclose the wrongdoing to the government.
